Terms & Conditions
(These terms were last updated on 26th July 2009 and will apply to all existing customers from 26th August 2009. Existing customers must raise any concerns before this date.)
Extreme Game Servers(EGS) believe that you (the customer) should receive the best service attainable at all times with as few restrictions as possible to how you use your service. To achieve this we have to insist that all our customers follow a few simple rules. These are listed below and can be provided in writing if needed. You must read these terms before purchasing any service we (EGS) provide and it is assumed you have read and agreed to be bound by these terms before you place an order with EGS. What does and does not constitute a breach of these conditions remains at the sole discretion of EGS at all times.
1 - Acceptable Usage Policy (AUP)
EGS have to insist that you agree not to use any of it's services in the following manner.
(a) - For the storing, distributing or promoting of any copyrighted or illegal material/s such as (but not limited to) software, images, video, audio, pornography or similar material.
(b) - For filesharing in any way whatsoever without the express written consent of EGS.
(c) - For the posting, sending or distribution of “SPAM” e-mails, “chain letters”, “pyramid schemes”, “phishing” scams or similar.
(d) - To Re-sell or rent any part of the service/s EGS have provided to you to any other third party.
(e) - To use any provided service, in full or in part, in any way that does or has the capacity to degrade the service of any other EGS customer or the ability of EGS to provide quality services to it's existing or potential customers.
(f) - For any activity that causes harm in any way to any individual, company or organisation whether intentionally or otherwise.
(g) - To harm or degrade the “reputation” of EGS in any way.
2 - Conduct
Unacceptable behaviour that could be described as (but not limited to) Insulting, Threatening, Sexual, Racial in nature by customers towards other EGS website/forum users, customers or EGS staff, it's agents or other representatives will not be tolerated and may result in your account and service/s being terminated immediately. Refunds to services cancelled as a result of this will be at the sole discretion of EGS.
3 – Cancellations & Refunds
You have the right to cancel your account at any time. To cancel your account you should logon to your billing control panel and submit a support ticket or cancellation request stating your wish to cancel your account.
If this method is not available for any reason we may accept cancellation requests using an alternative method but we would still require adequate proof of identity. As soon as your cancellation request has been accepted and acknowledged by EGS all your active services will be terminated and a refund of any funds owed by EGS to you for unused services will be made in full.
Exemptions to the normal cancellation refund terms will apply to customers accounts that have been cancelled by EGS for breaking our terms and conditions. All refunds made by EGS will be in the form of a cheque sent to the account customers provided address.
4 - Services & Payments
We accept payments for services via various methods such as PayPal, Google Checkout, Bank Transfer, and "PayOffline". Exactly which methods are available will be shown on the order page when you purchase your service from us.
All services will be considered to start from the date that your payment has cleared and the service is available for use by you and will continue to run unless specifically cancelled by the customer.
EGS operates all it's services on an automatically renewed basis. By using our service the customer accepts that is is their responsibility to cancel the service renewal if they do not want it to automatically renew.
The customer will be sent a reminder one week before the next due date and another reminder two days before the due date. If a payment hasn't been cleared by the due date your account will be marked as delinquent for a period of 1 day after which time the account will be automatically suspended until payment has cleared. Any account or service that is in a suspended state due to non payment by you will be classed as active and available by EGS for billing purposes unless a cancellation request has specifically been made by the customer.
Any accounts left suspended for a period of 15 days will be automatically cancelled by EGS.
5 - Availability of Service
The customer accepts that from time to time they may experience periods of unavailability of service (downtime). This may be due to (but not limited to) such factors as failures in hardware or software or the need for EGS to upgrade or maintain it's systems or any other factor not under direct control by EGS.
The customer agrees that in such cases of downtime they cannot claim breach of contract, claim refunds or extensions of service contract. Where this downtime is predictable or due to maintainance/upgrades, EGS will post the relative information on the news page on it's website as soon as it is possible to do so.
6 - Indemnity
The customer agrees to fully indemify and hold harmless EGS, it's owners, employees and agents from and against any and all costs, claims, damages, losses or expenses (inlcluding but not limited to reasonable legal fees) sustained or incurred by EGS, it's owners, employees or agents, either directly or indirectly as a result of :-
(a) - The customers non-observance or non-compliance with any of these terms & conditions
(b) - Any breach of any of the warranties or representations given by the customer in this agreement
7 - Changes
EGS reserve the right to change these terms and conditions at any time. This page will always display the current version of these terms and conditions.
